We're in the process of buying 37 acres. It currently has a mud pond which was built last year and still isn't completely full. I'm planning on having DH build a dam on the side that isn't full so I can have 2 seperate ponds. A stocked pond for fishing and a pond for waterlilies, etc. (MINE)
It's got a 34 x 64 pole barn and a cabin that's in the woods at the edge of the property.

DD and her BF are going to purchase 5 acres and we're going to sell off 1 1/2 acres near the road.
We've got to go thru permits yet such as septic and sub-division, which will take 2- 3 months because the county is sloooow.
Just thought I'd share....

Busy, I told him that I had to take my pond with me.. [-) I've got mixed emotions because I love it here but we just don't have enough room.
It will be at least 4-5 yrs before we move.

:lol: I'm laughing at we don't have enough room. Are you raising sheep or cows then??? Merlin and I would be more than happy with an acre each.

We've got just alittle over an acre which wouldn't be bad but we're on top of a hill so only 1/2 of that is flat. DH doesn't have the room here for his toys. His backhoe is currently sitting in the front yard, he really needs a pole barn.

Now it took me this long to even consider moving.. don't talk me out of it.

Well after all that work on the pond I'd be very reluctant to move. You said it will be 4-5 years before your move??? building a house???

Nice Bonnie, at least you'll have time to get it somewhat the way you want it before you move. ;-) I would love to be that far away from people, so much more peacefull.

Oh wait the cabin is nice too and a great place to have - you know - when the MRS kicks me out of the house and I need a place to stay LOL

Well folks.. the last 2 days haven't been very good. :-x
The seller is saying that he wants out of the deal, even though we have a contract! !grrrr

Supposedly, he doesn't want to go thru the headache and time that the county wants for dividing the house and land.
Even though he is living in FL and the realtor and myself have been doing all the work tha's involved in dealing with the county surveyor, planning and zoning, etc.
(he currently has a house and 2 acres that he is selling which has to be surveyed and subdivided)

As much as we love the land, we're about at the point to tell him to stick it! He's really doing us dirty, we went back and forth with him for 12 days with contracts, etc. Plus I've got many hours of time invested in planning and taking care of HIS job for him.

Keep us in your thoughts and hope the best for us!

Well that just sucks! Why put the property up for sale if he doesn't want what it entails...

Just be sure to offer to let him out af his contract with a big fee attached to it :razz: that way it may become 'worth' his while. Bummer.

Gals, I really think that something is going on behind the scenes. $$$ signs that is. The realtor asked me to call him last night and speak to him personally and he had every excuse possible that he just wants out.
His excuse(s):
$$ He wants to sell quickly because he's got bills to pay in IN and FL
$$$ He doesn't want the lot of the house to be "irregular"
$$$$ He wants to relist the property with the sale of the house
$$$$ blah, blah, blah...........

BTW, DH and I talked and later left him a voicemail telling thim that we would work out a deal which we would pay him so much down until the close. We thought that this would help him pay his bills!
He didn't even respond...... !bonk

Truthfully, we've now got mixed emotions. We really like the land but don't want to buy from a jerk either.
We're not going to let him out of the contract easily, unless it is going to cost us money in the long run.

The only way that he can make the contract invalid- For 2 weeks he has been told to get the County Board of Health to come to the property which goes to the house. Somehow they can't find the original papers of the septic system. Our county requires a Primary and Secondary Site. If the secondary site can not be put on the 2 acres that goes with the house, it will have to go on part of the property which is included in our contract.
It would be very rare if 2 acres would not pass inspection for septic approval.

I'm not the type to hire an attorney but am seriously thinking of talking to a real estate attorney on Monday. I do feel that we should get something out of this deal- after all I had to pay $500. upfront for earnest money incase we backed out. Why shouldn't he have to pay that to us??? :confused:

As long as it doesn't cost you more than what the contract outlines.... man this guy is topsy-turvy isn't he? I can't believe he didn't reply to your offer of money upfront... geesh.

If you REALLY want this place then yeah, contact a lawyer.... if the seller backs out you should get your $500 back! (and he owes you grief money too imho!)

Bonnie,

If you do wind up contacting a lawyer and filing a suit against him, you can have it set up where when he loses he has to pay your lawyer fees. I would make sure he knows that too.

So are you saying that the property has to hold another septic system if the first fails? Two acres should be plenty for that..

Terri, yes it's odd that we offered part of the money upfront and he didn't even respond. That shows he's got something else in mind or he's nuts.

Busy,The county requires a secondary area which a future septic system could be built, incase the first one fails. I agree, 2 acres should be sufficient. Problem is, the seller hasn't taken the time to call the health dept.

Merlin, thank you for the offer but I can use my boys here to sort him out!

Sellers often get remorse, some friend says you sold too low or they see in the paper that another property sold at a higher price.

Have you spoken to his realestate agent? Hopefully it will work out and he will sell the house and move so he won't be your neighbour...

Busy, yup that's what I'm assuming.

Jackie, he's already moved to FL. Luckily!
His realtor is in the same office as mine, they speak daily.
I'm going to call the realtors on Monday and suggest that we have a 4 way phone conference.
I will also be contacting an attorney on Monday.
I've already spent HOURS meeting with the surveyor, many hours of readingand corresponding on the requirements of planning and zoning commission and the health dept, bank for loan approval, electric, phone, water companies, etc.
5 different meetings at the land which we had to measure, stake and plan. (most of the days were in freezing temps with snow or rain)
Let alone 12 days going back and forth with the realtors.

The more I think about this, the more I want to prove to him that he can't treat us this way.
We're not giving in yet.........

I'll let you all know what I find out on Monday, stay tuned!

We're meeting tomorrow morning with the realtors, surveyor and Doug from the health dept. to discuss the seconday septic -which is yet to be determined if it can be located on the property which is being sold along with the house.

Hopefully there is sufficient room there .......This is the ONLY way the seller is going to be able to back out of the deal.

Best of luck being sent to you. Oh the trials and tribulations of realestate... am about to go through it myself. Not the house but some land my brother and I own. My parents have just listed their house and our land is next door so we will list at the same time. Hopefully some one will buy both parcels for privacy.

The secondary septic plot got approved to go on the 2 acres with the house! :smile:
The listing agent is contacting the seller today to give him the news but I really don't think the seller will have any other excuse now! :()

The surveyor is setting up a mtg for Friday so we can meet with the Planning and Zoning Commissioner for a pre application meeting on the sub division.

Please keep thinking of us though- and Terri uncross those fingers and toes... they're probably alittle cramped by now! :D

Luke so at $155,000, we're getting a good deal? ;)


Going tomorrow in the am for the pre-application meeting then to the bank to sign away before mortgage rates go up even more.
Wednesday is the land for the soil scientist to come and do the soil tests for septic.

Someday we might own the land!

I'd say that's a good deal. I'm selling less than an acre for about half that... and its not even in cottage country.... Land is pretty expensive in Southern Ontario. Mind in Northern Ontario I think they are still giving it away !wow!

Yes, just got the survey done, now the lawyer has to register the change with the town and hopefully that's the end of it until a buyer shows up. At lease I don't have to tidy up the house all the time for the tire kickers :lol:

Actually it's a great price here, land in large quantities is sold for at least double!

We got pre approval for a loan this morning BUT meeting with the planning commissioner didn't go as well as we wanted.

They are now wanting at least 5 acres if the land is zoned as agricultural.
It lists that the minimum is one acre but they are twisting the rules......
We can go thru the process and expensive and try to get it rezoned but I don't think we're going to go that far.

Also it's questionable as far as driveways because each drive is supposed to be no closer than 230' and our drive would be closer than that to the neigbors driveway. That isn't as big as an issue though.


What to do now.......... :-x

Well it could have gone worse. We jumped through lots of hoops to get the waterfrontage on our property (my brother and i own it) .. was supposed to be no less that 230 ft, and we only had 70... even less now but they let it go through but instead of being a right of way it was attached to our lot, good for us, not so great for my parents ;-) but truly they don't mind. The long distance calls and money spent on lawyers etc, when all was needed was a call to the Mayor.... Funny how small towns work, first they pass the laws then they bend them.... oh well....Both properties are now up for sale, but neither of them meet standards set by the municipality...

So have the mayor over for a nice dinner is my advice
